Suspension of 34-Hour Restart

March 31 2015

The new changes took effect when the president signed the 2015 budget bill. “FMCSA is preparing a Federal Register Notice, that will be posted on the FMCSA website, to advise the public that it is suspending enforcement of the restart restrictions as required by law. We are also working to ensure that the 12,000 state and federal motor carrier enforcement personnel are prepared to revert back to the previous restart."

The 2015 appropriations bill will suspend two provisions of the 2013 HOS rule:

(1) The requirement that drivers’ 34-hour restarts include two 1 a.m. to 5 a.m. periods and
(2) the provision that limits the use of the restart to once per 168 hours (a week). DOT officials are aware of the changes and the HOS enforcement is back to before the 2013 HOS rule changed the 34 hour restart.

We have completed the update to the 2013 HOS changes to reflect the changes above. All of our clients now have the current training. FMCSA has posted the changes to their website. I would print off a copy and keep it in the truck. Protect yourself.
